Mexico. In compliance with a ruling of the Second Specialized Court, which granted an amparo to Telcel, the Plenary of the Federal Institute of Telecommunications, IFT determined in its session IX the closure of the File that accounts for the complaint against Grupo Televisa for monopolistic practices referring to the refusal to sell advertising spaces during the transmission of the Pan American Games in 2011.
The file includes the complaint filed by Telcel where it accuses that GTV and Televisa denied it the provision of advertising space in Broadcast TV signals in order to grant advantages to Iusacell to facilitate its growth and consolidation in the related mobile telephony market, as well as to transfer its alleged substantial power in the advertising market to the related market.
In a first resolution, the Plenary of the Institute decided to close the file because the accused practices were not accredited. However, Telcel first filed an indirect amparo application against that determination and, subsequently, an appeal for review that was decided by the Second Specialized Court, which decided to modify the judgment under appeal and protect Telcel against the Closure (Enforceable) Resolution.
In compliance with the order, the first determination was left insubsistent, so the Plenary issued another resolution that corrected certain elements and that closes the file.
